Welcome to Hunt My Nest ("we," "us," or "our"), a real estate portal operating in the United Arab Emirates (UAE). By accessing our website and services, you agree to comply with these Terms of Use. These terms define the relationship between Hunt My Nest and its users, including responsibilities, restrictions, and legal provisions that govern the use of the platform. These Terms of Use establish legally binding rights and obligations concerning the use of the Hunt My Nest platform. If you do not agree with any of these terms, you are advised to discontinue the use of our services immediately. Continued use of our services constitutes your acknowledgment and acceptance of these terms.

2. Definitions

• "Platform" refers to Hunt My Nest’s website, mobile application, and associated services, including all tools, applications, and technologies used to facilitate real estate transactions.
• "User" refers to any individual, broker, agency, or entity using the platform to search, list, rent, buy, sell, or engage in any property-related transactions.
• "Listing" refers to property advertisements placed on the platform by users, including relevant images, descriptions, and pricing details.
• "Content" includes text, images, videos, and any other form of data uploaded or shared on the platform, either by Hunt My Nest or by users.

3. Eligibility

To use Hunt My Nest, you must:

• Be at least 18 years of age and legally capable of entering into contracts under the laws of the UAE.
• Provide accurate, truthful, and up-to-date information during registration and while listing properties.
• Use the platform only for lawful real estate transactions and refrain from engaging in fraudulent, deceptive, or unethical practices.

We reserve the right to deny access to users who do not meet these eligibility requirements or who have previously been banned due to violations of these Terms of Use. Additionally, Hunt My Nest reserves the right to request further verification for identity confirmation if deemed necessary.

4. Account Registration & Security

• Users are required to register an account by providing accurate personal details such as name, email address, phone number, and any other requested verification documents.
• You are solely responsible for maintaining the confidentiality of your login credentials. Any unauthorized use of your account should be reported to Hunt My Nest immediately to prevent potential security breaches.
• We reserve the right to suspend or terminate accounts that engage in suspicious activity, violate our terms, or misuse the platform in any way, including but not limited to unauthorized access, multiple accounts creation, and identity falsification.
• Users must not share their account credentials or allow third-party access to their accounts.

5. Property Listings & Advertisements

• All listings must be genuine, accurate, and comply with UAE real estate regulations. Listings should include correct property details, up-to-date pricing, and real images.
• Users must not misrepresent properties or provide misleading information about their availability, ownership, or condition.
• Hunt My Nest does not assume responsibility for the accuracy, authenticity, or reliability of any listing posted by third parties.
• We reserve the right to remove any listings that violate our policies or are reported as fraudulent by users. Repeated violations may result in permanent account suspension.
• Listings must comply with UAE property laws, and all agents must be licensed by the relevant real estate authorities.

6. Payment & Subscription Services

• Our platform may offer premium listing options, featured ads, and other paid services to enhance the visibility of properties.
• Payments for premium services are processed securely via authorized payment gateways. Users are responsible for ensuring the accuracy of payment information.
• No refunds will be issued for paid services unless there is a proven technical issue preventing the service from being provided as advertised.
• We reserve the right to modify pricing, introduce new charges, or alter service packages at our discretion, with reasonable prior notice to affected users.
• Non-payment of services may result in suspension of premium features or account restrictions.

7. Prohibited Activities

Users of Hunt My Nest must not:

• Post fraudulent, misleading, or deceptive listings or advertisements.
• Engage in data scraping, automated account creation, or any form of unauthorized data extraction from our platform.
• Upload viruses, malicious software, or any content that could compromise the security of our platform or its users.
• Use the platform for illegal property transactions, money laundering, or any other unlawful activity.
• Impersonate other users or misrepresent your identity or relationship with any entity.
• Engage in spam activities, including excessive messaging or promotional content.

8. Intellectual Property Rights

• The design, branding, and content on Hunt My Nest are protected by intellectual property laws and cannot be copied, modified, or distributed without prior written consent.
• Users retain ownership of the content they upload but grant Hunt My Nest a non-exclusive, royalty-free license to use, display, and distribute such content as necessary to operate the platform.
• Unauthorized use of our intellectual property will result in legal action.

9. Liability Disclaimer

• Hunt My Nest acts solely as an intermediary between property buyers, sellers, renters, and agents. We do not own, manage, or verify the properties listed on our platform.
• Users are encouraged to conduct their own due diligence before engaging in any transaction.
• We are not liable for any financial loss, fraud, or disputes arising from interactions between users.
• We do not guarantee that the platform will always be available or error-free, and we are not responsible for any technical failures or downtime.

10. Termination & Suspension

• We may suspend, restrict, or terminate user accounts if they violate our policies or engage in fraudulent activities.
• Any unpaid fees remain due even after an account is terminated.
• Users may request to deactivate their accounts by contacting our support team.
• Suspended accounts may appeal their case by submitting a formal request for review.

11. Governing Law & Dispute Resolution

• These Terms are governed by UAE laws.
• In the event of a dispute, users agree to resolve issues through arbitration in Dubai, unless otherwise required by law.
• Hunt My Nest reserves the right to initiate legal proceedings against users who violate our terms in any jurisdiction deemed appropriate.

12. Changes to These Terms

We reserve the right to modify these Terms of Use at any time. Continued use of the platform constitutes acceptance of any updates. Users will be notified of significant changes via email or platform notifications.

13. Confidentiality of User credentials 

Users are responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account.

13. User-Generated Content Disclaimer

    Users are solely responsible for the content they post, including property listings, comments, or messages. Hunt My Nest does not endorse, verify, or guarantee the accuracy of any user-generated content and disclaims all liability arising from such content.

14. Third-Party Links and Services

    Our platform may contain links to third-party websites or services that are not owned or controlled by Hunt My Nest. We are not responsible for the content, policies, or practices of these third-party sites and you access them at your own risk.

15. Data Usage and Analytics

    Hunt My Nest may collect and analyse user data and behaviour in anonymized or aggregated forms to improve services, content, and functionality. Personal data will be handled in accordance with our Privacy Policy.

16. Limitation of Liability:

    To the maximum extent permitted by law, Hunt My Nest shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, arising out of or related to your use of the platform.

17. Force Majeure

    We are not responsible for any delay or failure to perform due to events outside our reasonable control, including natural disasters, cyberattacks, or government restrictions.

18. Modification of Services

    We reserve the right to modify, suspend, or discontinue any part of the platform at any time without prior notice. Users will not be entitled to any compensation in such cases.

19. Language and Translation Disclaimer

    If these Terms are translated into other languages, the English version will prevail in the event of any inconsistencies or disputes.

20. Platform Modifications and Technical Limitations

    Hunt My Nest continually strives to enhance platform performance, user experience, and operational efficiency. As such, the platform’s structure, algorithms, workflows, features, and functionalities are subject to change at any time without prior notice. While most updates aim to improve usability, user engagement, and system performance, some changes may be required due to compliance with UAE laws, regulatory guidelines, or industry practices. In certain circumstances, specific features, modules, or services may be temporarily unavailable or limited due to technical constraints, ongoing maintenance, or external factors beyond our control. In such cases, Hunt My Nest will make reasonable efforts to notify affected users and provide timely updates. Users acknowledge and agree that temporary service disruptions, feature limitations, or system modifications shall not constitute a breach of these Terms.

21. Service Availability and Refund Disclaimer:

    While Hunt My Nest endeavours to ensure continuous and uninterrupted access to its platform and services, we do not guarantee that the platform will be available at all times. Users acknowledge that the platform may occasionally become unavailable due to scheduled maintenance, technical failures, infrastructure upgrades, server issues, internet outages, third-party service disruptions, or unforeseen circumstances beyond our control.

    Accordingly, Hunt My Nest disclaims all liability for any direct or indirect loss or inconvenience caused by such downtimes or service interruptions.

    No refunds, exchanges, extensions of service, or compensation shall be offered in the event of temporary or extended downtime, regardless of whether the user has subscribed to paid services or is participating in a promotional offer.

    By using the platform, users expressly agree that access to services is provided on a best-effort basis, and that temporary disruptions do not constitute grounds for any form of refund or liability claim against Hunt My Nest.

22. Promotional Free Access Period for Agencies:

    Hunt My Nest is offering a limited-time promotional free usage period of six (6) months to newly registered real estate agencies, starting from the date of each agency's registration on the platform.

    This promotional offer is only available to agencies that register within the first six (6) months following the official launch date of the Hunt My Nest portal (the “Promotional Period”). Registrations received after the Promotional Period will not be eligible for this offer and will be subject to the standard subscription pricing and terms in effect at that time.

    Eligibility for the promotional offer is strictly subject to Hunt My Nest’s internal evaluation and approval process. Hunt My Nest reserves the right to approve, reject, or revoke eligibility at its sole discretion, based on criteria defined within its onboarding and agency vetting procedures.

    During the applicable free access period, approved agencies may utilize the platform’s property listing services and related features without charge. The free access will automatically expire at the end of the six-month term from the date of registration. Hunt My Nest may, at its discretion, send a courtesy notification prior to expiration; however, failure to receive such notification shall not extend or alter the expiration of the free access period.

    This offer is non-transferable, limited to one-time use per agency, and may not be combined with any other discounts or promotions.

23. Right to Modify or Terminate Offer

    Hunt My Nest reserves the right to modify, suspend, or terminate this promotional offer at any time, with or without prior notice. Such changes will not affect agencies already enrolled and approved under the offer prior to the effective date of modification or termination.

24. Changes to These Terms

    Hunt My Nest reserves the right to update, modify, or revise these Terms of Use at any time, at its sole discretion. Such changes may be made to reflect internal policy decisions, changes in market conditions, or updates to UAE laws and regulations.

    We may notify users of material changes via email or platform notifications; however, it remains the user's responsibility to review the Terms periodically. Continued use of the platform after any changes are published constitutes acceptance of the revised Terms.

25. Financial Transactions and Communication Disclaimer

    Hunt My Nest is a neutral digital platform designed to connect real estate agencies, agents, property owners, and potential buyers or renters. The platform does not act as a party, intermediary, representative, or guarantor in any financial transactions, price negotiations, contractual agreements, or payments between users.

26. Changes to These Terms

    We reserve the right to modify these Terms of Use at any time. Continued use of the platform constitutes acceptance of any updates. Users will be notified of significant changes via email or platform notifications.
